BAGUIO CITY – Some things do last beyond one’s lifetime.

Yu Hwa Ping, the controversial Fil-Chinese businessman who never gave up his quest to develop a parcel of land along Chuntug Street had reason to celebrate January 25, when the Office of the President (OP) granted his wish to secure title over the property.

Two days after he received good news, he had a heart attack and passed away. But the claims adverse his, survives another day.

The City Legal Office, February 22, filed motion for reconsideration (MR) over the OP’s reversal of the Department of Environment and Natural Resources’ (DENR) findings the Hwa Ping title “was not regularly and validly issued.”

The MR was filed in behalf of city building official Oscar Flores and Department of Public Works and Highways (DPWH) secretary Hermogenes Ebdane, the appellees.

Apparently, the OP failed to appreciate a DENR report dated May 16, 2008 pointing out the Original Certificate of Title (OCT) No. P-2607 issued to Hwa Ping encroached upon a DPWH-identified road-right-of-way.

They prayed the OP “consider the aforementioned (report) as it would appear [Hwa Ping] was not candid enough to disclose [the] matter to the OP.”

“If the document was revealed,” they added, “the decision sought to be reconsidered would have been rendered in a different tune.”

It could be remembered the DENR issued Special Order (SO) No. 14 creating a team to conduct investigation for possible filing of cancellation proceedings over the title issued on a road-right-of-way (RROW) along Chuntug.

Erstwhile DENR-Cordillera regional executive director Samuel Penafiel named Atty. Joseph Humiding (chair), Atty. Cleo Andrada, Engr. Wilbert Mangliwan, Evelyn Wales, Norbert Aquino, and Filipinas Mallare as members of the team. 

The team subsequently reported the title issued to Hwa Ping “is not appropriate for disposition under Townsite Sales Application (TSA)… [as] it straddles the  RROW of Chuntug identified as secondary national road,” reversing earlier findings by a group of surveyors commissioned under Administrative Order (AO) No. 69-1998.

The AO 69 group was formed by then mayor Mauricio Domogan to settle all the technical issues involving the questioned lot sometime in 1988.

On top of that, the appeal tipped the OP: there were nil Presidential Proclamations reclassifying the questioned property measuring 360 sq. m. into an alienable and disposable land.

Meantime, AZCKO barangay chair Vicente Pinlac was likewise hauled over the coals for issuing certification there was no ongoing construction over the property – an alleged slant of facts which the appellees claimed could have likewise altered the OP’s decision.

In fact, the appellees pointed out, Demolition Order No. 36-1998 was issued against Hwa Ping in 1998.**gani liporada

BAGUIO CITY – Peeved by apparent series of ‘almost covert’ encumbrances over prime national government realties the Baguio government eyes for public purposes, mayor Reinaldo Bautista, Jr. last week wrote the city council giving ‘em a penny for their thoughts.

In a March 3 letter, the mayor said, “We have to look at [our city] as one big pie and not mere chunks,” alluding to the reactive stance the city has been taking in meeting various land conveyance issues where it finds itself in the defensive end.

He bared the local government now faces possible withdrawal of the Office of the President (OP) of the property the Presidential Management Staff (PMS) conveyed to the city May 13, 2004, otherwise known as the Dominican Heritage Hill.

Other catch 22’s include the sale of several parcels of land along Gov. Pack Road, otherwise known as the Southbound Terminal (ST); and the DPWH easement now titled in the name of one Yu Hwa Ping.

He revealed that in a recent conversation with president Gloria Macapagal – Arroyo, “It was apparent the botched plan to construct the Mining Museum [at Dominican Hill] was much of a concern, considering the city has gone beyond the 5-year term for compliance of the project the parties were obliged by contract to implement.”

“Apparently,” he added, “PMS sees our infusion of about P15-million in the construction of fences in [Dominican] not as development but merely stalling the inevitable – the reconveyance of the property by virtue of our non-compliance with our obligations.”

He lamented, “Clearly, the PMS in its more recent communications is bent on enforcing the said agreement to point of withdrawing the said land from our assets.”

On the Gov. Pack Road issue, he disclosed on February 26, Coun. Isabelo Cosalan and administrator Peter Fianza delivered his appeal and conferred with DENR Sec. Horacio Ramos, to stall bidding for sale of lots along the ST.


”Thanks to our reps aptitude in persuasion, the Honorable Secretary has responded to our call favorably,” he said.

But land conversion issues do not end there. Last February 22, the city legal office filed reconsideration with the OP regarding its decision granting title to Fil-Chinese businessman Yu Hwa Ping over a highly contested parcel of lot along Chuntug street.

The lot awarded late in January is being contested for straddling over an identified road-right-of-way.

Bautista enthused, “While I am aware that we are ready to go to court to enforce our [rights]… another situation has presented itself which may give the national government and the local government of Baguio a win-win solution to [our dilemmas].”

He proposed the city give way to the proposal of ambassador to Germany Delia Albert group’s proposal to construct a Baguio Historical and Mining Museum at Dominican.

He added, “The project along with city-led development of the unused portions of the realty as Heritage Park would certainly be a tourist attraction that would satisfy the requirements demanded by each and of all the parties involved in the property.”

However, he suggested, “The city’s giving way to the construction of a Baguio Historical and Mining Museum be used as a bargaining chip in requesting Malacañang to issue an Executive Order conveying the Gov. Pack Road property… to our local government for a city-managed southbound terminal.”

On top of this he added the accession by the city to Albert’s proposal likewise be used to bargain for reversal of the OP decision over the Chuntug lot.

He thus requested asked the council to prepare the necessary legislative measures on his recommendations and to authorize him the duty of representing the city to bargain with Malacanang.

He added, “I appeal to you before our chapter of governance would soon end… Let us give way to compromise lest we waste countless years and money in arduous court litigations.”**gani liporada

QUEZON CITY – Alderman Isabelo Cosalan and city administrator Peter Fianza in a buzzer beater, February 26, gave new meaning to the ‘theory of relativity’,  swaying the Department of Environment and Natural Resources (DENR) top honcho to stay sale of lots along Gov. Pack road.

The conduct of bidding of several parcels of land denominated as portion of the controversial Original Certificate of Title (OCT) No. 1, situated at Residential Section ‘A’, Gov. Pack Road, has been scheduled March 1 to 23, 2010.

Stirred by promise the area shall remain for southbound busses, the two endured same day’s travel leaving at 3:00am nil appointment with newly-installed DENR secretary Horacio Ramos.

They were armed with a letter-appeal by mayor Reinaldo Bautista, Jr. and prayer they could make a personal call despite stringent protocols barring walk-in visitations with the secretary. He is, after all, the president’s alter ego.

Arriving here at 9:00am, their fears being showed the easiest way out the DENR Central Office Building was confirmed: no walk-in visitors, no matter how urgent the business was, were ever allowed to the top dog’s office unless he was president of the republic.

Besides, the secretary was in Malacanang for a DENR press-briefing.

They shifted to ‘plan B’ - enlisting aid from media friends to locate Ramos in the palace and to arrange an instant rendezvous.

It was only at 2:00pm that the team was informed their main man has left the building. With some prodding from their contacts, they proceeded back to DENR central.

This time around, Cosalan not wanting to go home kaput changed gears from his usual docile Ibaloi nature to a man on a mission and declared the “C” of Ramos’ middle name was spelled out “Cosalan” to the DENR front desk clerk.

He was the secretary’s nephew, after all. Within a few ticks, the team was at the office of Ramos with coffee on the side.

The team got the hold order they came for and Ramos vowed to look into apparently doubtful disposition of properties covered by OCT 1. It was a few ticks before 5:00pm when the city team left… all smiles.

Meanwhile, Bautista in his letter explained the area subject of sale known as site depot for southbound busses.

“Disposition of said lands by mode of sale… would change the nature of the property as private landholdings evermore, which will thus greatly affect our established order in traffic and dispatch of southbound mass transportation,” he added.

Earlier during an emergency consultation called by Cosalan and Fianza, 15- of the total 17- lot occupants feared deprivation of use and possible ownership of the realty.

They claimed valuation for sale over the property occupied and developed by their ancestors over 50-years ago were too excessive.

It was the two officials who suggested the occupants seek injunctive relief while they pursue administrative aid straight from the DENR secretary.

Bautista in his letter meantime averred, “The Republic of the Philippines [under whose name the property is titled,] would earn more down the line if it leased the properties.”

He likewise pointed out under a memorandum dated January 12, 2007 for the director, Land Management Bureau, from members of an appraisal committee constituted under DENR Special Order No. 108-1998, “The scope and purpose of the appraisal… is in preparation for bidding for lease and not of sale.”

He added, “While [DENR] Regional Executive Director Clarence Baguilat in his February 19, 2010 letter claims there is no difference between ‘lease’ and ‘sale’ as the appraisal value [are the same for both, his] reasoning would seem to create absurdity when it comes to the very definition of sale and lease pursuant to law.”

Bautista thus urged Ramos to create a multi-agency committee to include Baguio government reps “to review the disposition of properties… and to resolve all issues a propos OCT 1.”

Among the issues he raised were the sale of portions of OCT 1 to SM Investments Corporation; the request for setting aside portions thereof for purposes of the City Government of Baguio; the need to finalize metes and bounds of OCT 1 to put order in the otherwise conflicting records in existence; and the need to clarify why some of the lots lined up for sale fall on identified rights-of-way.

On related development, the Southbound Bus Terminal group represented by one Zenaida Monteclaro and joined by the City Government of Baguio were able to secure Temporary Restraining Order (TRO) likewise stopping the sale of the Gov. Pack properties.

Absent during the TRO hearing despite notice were representatives of DENR constraining Regional Trial Court (RTC) Branch 3 judge Fernando Vil Pamintuan to issue relief sought.

Hearing on the application by the same plaintiffs for a writ of preliminary mandatory injunction is set March 12.** gani liporada

BAGUIO CITY – The painting showdown in the Panagbenga may have been scrapped this 2010… but there sure were a lot of ‘em kicks to go around.

The Baguio Defenders Taekwondo Gym (BDTG) virtually bullied their opposition raiding 23 of 50-golds in the 7-do jang (gym) Panagbenga Taekwondo Championships, February 27.

Tournament director Melvin Morte revealed the legal carnage was participated by 227-jins at the Baguio City National High School (BCNHS) Gymnasium.

BDDG finished with a dominating 23-21-32 gold-silver-bronze tally; Bravehearts (BH) finished second with 10-7-10; while GB Sports (GBS) placed third with 6-6-7.

Completing the medal count were University of the Cordilleras Jaguars (UCJ), 5-5-3; UFC-Art Haven (UFC-AH) 4-7-12; and Benguet (Beng.) with 0-1-4.

The Defenders, coached by Palarong Pambansa skipper Arnold Oglayon had an early start painting their opposition black and blue in the elementary division winding up with 5-golds in the girls division and 5-golds in the boys category.

The jins who mastered their categories in the girls elementary division include Ailester Fias-ilon (BDTG), Josiphine Pistola (BDTG), Brighty Salazar (BDTG), Ezra Gagaoc (GBS), Emma Bayubay (UFC-AH), Jerimei Tabisula (GBS), Keira Lipao (BH), Aitana Fias-ilon (BDTG), Jheann Alunday (BDTG), Kaye Duday (GBS),

Topping the elementary boys were Juris Quiambao (BH), Monsour Salazar (BDTG), Kendrix Galian (BH), John Astrologio (UFC-AH), Atilla Fias-ilon (BDTG), Angelo Ramos (BDTG), Clyde Duday (GBS), Jack Natividad (BDTG), Joshua Pasag (BDTG), Christian Guzman (UFC-AH), Jobe Macario (UFC-AH), Justin Nacua (BDTG), Milard Saguil (BDTG), Kim Aquino (BDTG), and Ericson Serrano (BCNHS).

Meantime, BDTG continued its rampage by ruling the juniors (high school) division bagging 5- of 10-golds.

Tiffany Delizo ruled the fin weight category saving the BDTG from possible El Niño in the female juniors advance division.

Jullia Munar and Devorah Alacar on the other hand bested the fly and combined bantam-feather weight divisions to score for team BH; while Kate Dumo of BCNHS captured first gold for her team in the bantam-middle weight category.

BDTG rebounded in the men’s junior category via golden finishes from Benjamin Keith Liporada – Sembrano in fin-fly weight advance category, Anfernee Dizon in feather weight novice 1, Patrick Castillo in heavy weight novice 1, and Joshua Dominic Lazaro in heavy weight novice 2.

Other golden performances were demonstrated by James Matundan (GBS) in the fly-bantam novice 1 and Genaro Tumayan (BH) in fin-fly novice 2.

It was the same story in the seniors (college) division with Betchie Bunagen (bantam-light novice 2) bagging lone gold in the women’s division for BDTG.

The BH amazons bounced back via wins from Korinah Natura (fin-bantam advance) and Sheena Asan (feather-light advance). Their performances were matched by equally superb showings from Junelyn Ramos (fin-fly novice 1) and Love Buyayawe (novice 2).

Finally, in the senior men’s category, BDTG sowed fear kicking away with 4- of possible 9-golds.

BDTG’s fin-fly machine Billy Soria sent his opposition out the gym horizontally in the Sr. men’s advance division. His exploits was aptly replicated by Fernand Delizo (bantam-feather advance), Harold Martinez (light-heavy advance), and John John Lachica (fin novice 1).

UCJ on the other hand finished decent second garnering 3-golds via excellent performances from Joey Fernandez (fin-fly novice 1), Albert Pay-an (fly-bantam novice 2), and Cris Nanglihan (feather-light novice 2).

Rounding up the senior men’s division’s gold miners were BH’s Solano Tacay (feather-light novice 1) and Severino Khita (heavy novice 1).

Oglayon in a post-battle interview credited his wards’ in-training patience and discipline for BDTG’s finish. Paraphrasing boxing pound-per-pound king Manny Pacquiao he said, “The battle is easy if you train hard… my kids did just that while maintaining good grades in school.”

Oglayon and Morte invited kids to learn Taekwondo discipline via the Milo Taekwondo Summer Clinic from April 5 to May 30; and the Summer Taekwondo Tournaments sometime this March and April..**gani liporada

BAGUIO CITY – The celebration of women’s month in this mountain city kicked off with the presentation of 4 women achievers – winners in their own rights.

Councilor Betty Lourdes Tabanda formally introduced them during last Mondays flag raising ceremony which marked the start of Women’s Month.

The women were chosen for their outstanding contributions to the community coupled by their strength of character which emanates beyond their families.

Among the women who were presented awards included Patricia Gallardo, Rebecca Pawid, Marivic Bugasto and Rose Wasan.

Gallardo is the organizer of "Save our Women Against Violence Foundation", a non-government, non-profit organization dedicated to provide support to victims of violence.

Her group is intensifying its advocacy to stop all forms of violence against women.

Pawid is presently the Jail Warden of the city. She is cited for her exceptional ability to be in charge of a male-dominated detention center where almost 70% of inmates are males.

Bugasto on the other hand is a victim of cancer. She has been courageously fighting the dreaded disease unmindful of the pain, expenses and depression it has caused her.

She has organized "Minda’s Buddies", a group of survivors which gives support and hope to other victims of cancer.

Wasan advocates governance in the barangay level. She encouraged the organization of women in the barangays dedicated to women empowerment.

Gallardo revealed 7 out of 10 women are being abused by someone they know be it physical, emotional, psychological and economical.

She said her group is trying to spread awareness against domestic and intimate violence stating "we are not anti-men but anti-violence".

With the signing of Republic Act 9710 or the Magna Carta for Women, it affirms the role of women in nation building and provides for equal access to resources and opportunities.**Paul Rillorta
